[2026:RJ-JP:20409] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No.6333/2019 Vinod S/o Ram Kishan, R/o Jhadoli, Police Station Sadar Alwar, District Alwar. ----Petitioner Versus 1. State Of Rajasthan, Through PP. 2. Superintendent Of Police, Alwar. 3. SHO Police Station Alwar, District Alwar. ----Respondents For Petitioner(s) : Mr. Rohan Singh for Mr. S.S. Sunda For Respondent(s) : Mr. Jitendra Singh Rathore, PP JUSTICE ANOOP KUMAR DHAND Order 14/05/2026 1. By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Officer for conducting fair and impartial investigation of FIR No.269/2019 registered with Police Station Sadar Alwar, District Alwar for the offence punishable under Section 302 IPC. 2. Learned counsel for the petitioner submits that for the incident dated 16.05.2019, the impugned FIR was registered with the concerned Police Station on 17.05.2019. However, even after passing of considerable time, till date, the investigation has not been conducted in a fair and impartial way. Hence, appropriate directions be issued. 3. Per contra, learned Public Prosecutor opposed the prayer made by learned counsel for the petitioner and submitted that the [2026:RJ-JP:20409] (2 of 2) [CRLMP-6333/2019] Police has thoroughly investigated the matter in a fair and impartial manner. 4. Heard and considered the submissions made at the Bar and perused the material available on the record. 5. At the relevant time, the petitioner approached this Court in the year 2019 with the aforesaid prayer. More than seven years have passed thereafter and no efforts were made for listing of his matter and arguing the instant petition. It appears that in the meantime, the conclusion report might have been submitted by the concerned Investigating Officer. Hence, under such circumstances, the instant misc. petition has been rendered infructuous. 6. Accordingly, the instant criminal misc. petition stands dismissed as having become infructuous. Stay application as well as all pending applications, if any, stand disposed of. 7. However, in case the matter is still at investigation stage with the concerned Investigating Agency, the petitioner would be at liberty to file appropriate representation before the concerned Investigating Officer for conducting fair and impartial investigation. In case any such representation is submitted by the petitioner, the same would be looked into and appropriate action would be taken by the Investigating Officer. 8. The Superintendent of Police, Alwar is directed to monitor the investigation, in case the investigation is still pending and ensure that the result of investigation under Section 173 Cr.P.C. is submitted before the concerned Court, expeditiously as early as possible.
