JUDGMENT OF CONVICTION AND SENTENCE AFFIRMED BY THE LEARNED C/C LXI ADDL. CITY CIVIL AND SESSIONS JUDGE, AT BENGALURU IN CRL.A.953/2023 DATED 27.01.2023 AND THE JUDGMENT OF CONVICTION AND SENTENCE PASSED BY THE LEARNED XII ACMM, AT BENGALURU IN CC.NO.2167/2021 DATED 16.06.2023, WHICH COURT HAD CONVICTED THE PETITIONER FOR THE OFFENCE P/U/S 138 OF N.I. ACT AND SENTENCED TO PAY FINE RS.3,92,000/- AND IN DEFAULT TO UNDERGO S.I. OF 06 MONTHS AND FURTHER PLEASED TO ACQUIT THE PETITIONER IN THE ABOVE CASE.

ORAL ORDER After addressing the arguments for some time, learned counsel for the revision petitioner files a memo. Memo reads as under:
“That the petitioner has already deposited 50% of the cheque amount of Rs.3,82,000/- and remaining 50% of the amount will be paid by the petitioner in 8 installments commencing from 01.05.2026 to 30.01.2027; the petitioner has no objection to withdraw the amount deposited before the learned Trial court by the respondent. The respondent has no objection for the same. Hence kindly accept the same in the interest of justice and equity.”

Learned counsel for the respondent has endorsed no objection on the memo.
3. Placing the memo on record, revision petition stand
disposed of.
4. Amount in deposit is ordered to be withdrawn by the complainant under due identification.
5. It is made clear that if any one of the installment is not paid as per the memo, revision petitioner shall undergo imprisonment ordered by the learned Trial Magistrate confirmed by the First Appellate Court.
6. After payment of entire fine amount, amount of Rs.5,000/- ordered by the learned Trial Magistrate confirmed by the First Appellate Court towards defraying expenses of the State stands set aside.
