MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 22.04.2026
01.
1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Rasgobindpur P.S. Case No.43 of 2026 corresponding to C.T. Case No.41 of 2026 pending in the court of learned J.M.F.C., Rasgobindpur on the grounds stated.
3. Perused the F.I.R. as at Annexure-1. Recorded the submission of Mr. Tripathy, learned counsel for the petitioner and Ms. Nayak, learned counsel for the informant besides the State. The Court finds that ornaments and cash were stolen from a temple during night. It is claimed by learned counsel for the State that the involvement of the petitioner could be identified through a CCTV footage. Considering the nature of mischief committed in respect of a temple with the removal of cash and ornaments, this Court is not inclined to consider the bail plea of the petitioner, who is at liberty to surrender before the court of learned J.M.F.C., Rasgobindpur seeking regular
bail for its consideration on merit and in case of rejection to approach the Sessions Court for orders on same day.
4. Accordingly, it is directed.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders within a fortnight from today and moves application for bail in connection with C.T. Case No.41 of 2026 arising out of Rasgobindpur P.S. Case No.43 of 2026 pending in the Court of J.M.F.C., Rasgobindpur, it is directed that the same shall be entertained during the first hour followed by an order and in the event of rejection, he is at liberty to approach the Sessions Court during the second hour for orders on the same day and for the said purpose, the lower court case record and other relevant papers shall be made available at the time of hearing.
