The petitioner is apprehending his arrest in connection with Nawadih P.S. Case No.77 of 2025 for the alleged offences registered under Section 376 of Indian Penal Code, pending in the Court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that in the FIR itself it has been stated that the informant and the petitioner were in love and they have established the relationship several times and even she has resided along with the petitioner without any protest in Mumbai for 18 months and thereafter the marriage was solemnized with another person. He further submits that the allegations are made that thereafter the petitioner has threatened her husband to leave the informant and husband has 2026:JHHC:11758 --2-- A.B.A. No. 1873 of 2026 left the informant and thereafter the case has been lodged on 24.12.2025. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of threatening the husband of the informant and pursuant to that her husband has left and thereafter the case has been lodged. 5. In the FIR itself it has been stated that the relationship is since 2024 and the informant is major and she has also resided without any protest for 18 months along with the petitioner in Mumbai and thereafter the marriage has been solemnized with another person on 08.07.2025 and thereafter the FIR has been lodged on 24.12.2025 and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
