ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following relief:
“Issue a writ in the nature of mandamus directing the second respondent to initiate action against the third respondent for having violated the Rules issued by the first respondent as per the Official Memoranda F.No.11013/1/ 2016-Estt.A-III dated 05.08.2019, 27.02.2020 and 31.08.2022 at Annexure-D in the interest of justice and equity.”
2. The case of the petitioner is that he was an employee of the Postal Department and also a member of

the Karnataka Circle Postal Credit Co-operative Society. He submitted a representation dated 24.01.2024, vide Annexure-B, and also issued a legal notice to the second respondent, requesting necessary action against respondent No.3 pursuant to the Office Memorandum dated 27.02.2020.
Since the second respondent did not take any action, the petitioner approached this Court. 3. The learned counsel appearing for the second respondent contended that, pursuant to the representation submitted by the petitioner, respondent No.2 issued an endorsement dated 19.03.2024, vide Annexure-R2, stating that the Office Memorandum dated 27.02.2020 has been challenged before the High Court of Madras in WP No.21139/2021 and is currently stayed. Therefore, the second respondent could not take any action. It was further noted that respondent No.3 retired from service on
31.08.2024. Hence, the respondent sought dismissal of the writ petition. - 4 -

In this writ petition, the petitioner has sought a direction to respondent No.2 to consider the representation dated 24.01.2024, vide Annexure-B, and the legal notice dated 21.02.2024, vide Annexure-C, to take action against respondent No.3 pursuant to the Office Memorandum dated 27.02.2020. 5. The representation of the petitioner has already been considered, and an endorsement dated 19.03.2024, vide Annexure-R2, has been issued stating that the Office Memorandum dated 27.02.2020 is stayed by the Madras High Court in WP No.21139/2021, and that respondent No.3 has retired from service. 6. In view of the above, the relief sought by the petitioner does not survive for consideration. Accordingly, the writ petition is dismissed. If the petitioner has any other remedy available, he may invoke the same in accordance with law, if permitted. - 5 -
