JUSTICE DEVASHIS BARUAH ORDER 22.05.2026 Mr. D Rathi, the learned counsel appearing on behalf of the petitioner submits that the petitioner would be well advised to challenge the vires of Section 30 of the Railways Act, 1989 along with the Notifications and Circulars which have been impugned in the instant writ petition. The learned counsel, therefore, submits that the petitioner may be permitted to withdraw the instant writ petition without prejudice to challenge the vires of Section 30 of the Railways Act, 1989 along with the impugned Notifications and Circulars. 2. Taking into account the above submission, this Court closes the instant writ petition on withdrawal. 3. It is observed that the withdrawal of the instant writ petition shall not prejudice the petitioner to assail the vires of Section 30 of the Railways Act, 1989 along with the impugned Notifications and Circulars, if so advised.
