By the said order, parties to the partition suit have been restrained from alienating the land in question. Petitioner has also challenged the said order in a revision petition, filed under Section 333 of Zamindari Abolition and Land Reforms Act, and his revision petition, which is numbered as Revision No. 18 of 2025-26, is pending before Commissioner, Garhwal Division. (3) Since petitioner has challenged the same order in this writ petition which he has challenged in the aforesaid revision petition, therefore, writ petition is dismissed as petitioner cannot simultaneously maintain two proceedings against interim order dated 3.6.2025. (4) This Court hopes and expects that learned Revisional Court shall make endeavour to decide the revision as early as possible.
