Heard Mr. A.K. Gupta, learned counsel for the applicant.
2. This interlocutory application is preferred by the applicant, namely Ankit Agarwal, for releasing the awarded amount of Rs. 76,236/-, being deposited by the respondent Nos. 3 & 4 before the learned Member, MACT o. 2, Kamrup (M) at Guwahati (Tribunal hereinafter), on 11.06.2025.
3. Mr. Gupta, learned counsel for the applicant submits that though the amount was deposited before the learned Tribunal, the said amount could not be released by the learned Tribunal as the record has already been transmitted to this Court in MAC Appeal No. 361/2025.
3.1. Mr. Gupta further submits that the applicant is working in Indian Oil Corporation Limited at Haldia and as such, his engaged counsel or his father may be allowed to receive the said amount and that one authorisation letter is annexed in this interlocutory application, as Annexure – B, at page No. 11.
4. Accordingly, taking note of the submission of Mr. Gupta, learned counsel for the applicant this Court is inclined to dispose of this interlocutory application by
Page No.# 3/3 directing the father of the applicant, namely Kamal Agarwal, to file an application before the learned Tribunal with authorization letter of this son and on such application being filed, the learned Tribunal shall release the cheque in favour of the father of the applicant after proper verification.
