Mr. Ziaul Haque Mr. Mazhar Hossain Chowdhury ….for the petitioners Mr. Chandi Charan De, AGP Mr. Haripada Maity ….for the State Affidavit of service filed in Court today is taken on record. The petitioners allege that the private respondent herein is carrying on illegal mining activities over the plot of the petitioners. Petitioners submitted a representation before the Sub-Divisional Officer and pursuant thereto a hearing was conducted by the Sub-Divisional Officer on February 11, 2026. The learned advocate appearing for the petitioners submits that the petitioners duly attended the said hearing but the decision taken by the authority on the hearing conducted on February 11, 2026 has not yet been communicated to the petitioners. The learned advocate for the petitioners further draws the attention of the Court to a letter issued by the Block Land & Land Reforms Officer dated February 24, 2026, requesting the Inspector-in-Charge, Rampurhat Police Station, Rampurhat, District-Birbhum to arrange for strict and regular surveillance so that no illegal mining 2 activity is carried out by anyone over the land in question in future. Since a hearing was conducted by the Sub- Divisional Officer on February 11, 2026, the reasoned order on the issue raised in the hearing should have been communicated to the petitioners. In view thereof, WPA 8016 of 2026 stands disposed of by directing the Sub-Divisional Magistrate, Rampurhat- I, Birbhum being the respondent No.9 to communicate the reasoned order passed on the hearing held on February 11, 2026 to the petitioners as expeditiously as possible but positively on or before May 15, 2026. The Inspector-in-Charge, Rampurhat Police Station, Rampurhat, District-Birbhum is also directed to comply with the directions passed by the Block Land & Land Reforms Officer, Rampurhat-I vide memo dated February 24, 2026. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
