Umar, learned counsel for the applicants. 2. Mr. J.P. Kandpal, learned A.G.A. for the State. 3. By means of the present anticipatory bail application, the applicants seek grant of anticipatory bail in the event of their arrest in connection with FIR dated 11.04.2026, registered as Case Crime No. 0159 of 2026, under Sections 3, 5 and 11 of the Uttarakhand Protection of Cow Progeny Act, 2007 and Section 3 read with Section 11 of the Prevention of Cruelty to Animals Act, 1960, at Police Station Kotwali Bhagwanpur, District Haridwar. 4. Learned counsel for the applicants submits that the impugned FIR has been lodged on the allegation that, during patrolling duty, the police received information that certain persons were selling beef in a field. Upon reaching the spot, the police party allegedly found that all the accused had fled from the place of occurrence. However, one accused was apprehended at the spot, who disclosed the names of the present applicants and other co-accused, alleging that they had supplied the beef to him. It is further alleged that beef and slaughtering equipment were recovered from the spot. The recovered material was thereafter inspected and sampled by the Veterinary Officer, on the basis whereof the present FIR came to be registered. 2026:UHC:4894 5. Learned counsel for the applicants further submits that the applicants are innocent and have been falsely implicated in the present case. It is contended that the applicants were not present at the spot at the time of the alleged recovery and that there is no independent witness to the alleged recovery, thereby creating serious doubt regarding the prosecution case. 6. Per contra, learned State Counsel opposed the anticipatory bail application and submitted that a substantial quantity of alleged beef was recovered during the raid conducted by the police. It is further submitted that the investigation is still in progress and that the applicants have criminal antecedents. 7. At this stage, learned counsel for the applicants submits that the applicants are ready and willing to surrender before the court concerned and seeks permission to withdraw the present anticipatory bail application with liberty to surrender before the competent court within a reasonable period and seek regular bail. It is further prayed that, till such surrender, the applicants may be granted protection from arrest. 8. Learned State Counsel has no objection to the aforesaid prayer. 9. Heard learned counsel for the parties and perused the material available on record. 10. Considering the facts and circumstances of the case, as well as the statement made on behalf of the applicants, the present anticipatory bail application is dismissed as withdrawn with liberty to the applicants to surrender before the court concerned on or before 17.07.2026 and seek appropriate relief in accordance with law. 11. Till 17.07.2026 or till the date of surrender, 2026:UHC:4894 whichever is earlier, the applicants shall not be arrested in connection with the FIR dated 11.04.2026, registered as Case Crime No. 0159 of 2026, under Sections 3, 5 and 11 of the Uttarakhand Protection of Cow Progeny Act, 2007 and Section 3 read with Section 11 of the Prevention of Cruelty to Animals Act, 1960, at Police Station Kotwali Bhagwanpur, District Haridwar, provided they cooperate with the investigation and make themselves available before the Investigating Officer as and when required. 12. It is made clear that, in the event the applicants fail to cooperate with the investigation or fail to surrender before the court concerned on or before 17.07.2026, the interim protection granted by this Court shall automatically stand vacated without any further order.
