Since all these appeals have arisen out of a common accident and since common question of law and fact is involved in all these appeals, therefore, they have been clubbed together, 6 heard together and are being decided by this common judgment. 2. These appeals have been preferred by the appellant – Smt. Shamshida Begam under Section 173 of the Motor Vehicles Act, 1988 (hereinafter, “the Act of 1988”) challenging the impugned awards dated 16/10/2018 passed by learned Second Additional Motor Accident Claims Tribunal, Rajnandgaon in Claim Cases No. 14/2017, 15/2017, 16/2017 and 17/2017 (similar but separate orders passed on the same date). 3. Mr. Rishi Sahu, learned counsel for the appellant, would make a solitary submission that the offending vehicle was sold and transferred to one Thalesh Kumar Sahu on 12/09/2016 i.e. prior to the date of the accident and the sale deed was executed on 26/11/2016 vide Ex. D/1C, therefore, the appellant could not have been made responsible for payment of compensation to the claimants and as such, the impugned award is liable to be set aside. 4. Learned counsel for the respondents would submit that accident occurred on 16/09/2016 whereas the transfer deed with regard to the offending vehicle has been executed on 26/11/2016 (Ex. D/1C), therefore, on the date of the accident, appellant was registered owner of the vehicle and as such, the 7 Claims Tribunal has rightly fastened the liability of payment of compensation upon her. 5. I have heard learned counsel for the parties, considered their rival submissions made herein-above and went through the record with utmost circumspection. 6. In this regard, the decision rendered by the Supreme Court in the matter of Naveen Kumar v. Vijay Kumar & Ors. 1 , may be noticed herein profitably whereby their Lordships of the Supreme Court, having regard to definition of ‘owner’ under Section 2(30) of the Act of 1988, have clearly held that the person in whose name motor vehicle stands registered (i.e. whose name is reflected in records of Registering Authority) would be treated as “owner” of vehicle for the purposes of the Act of 1988 and it has been observed in paragraph 14 as under :- “14. The submission of the petitioner is that a failure to intimate the transfer will only result in a fine under Section 50(3) but will not invalidate the transfer of the vehicle. In T.V. Jose2, this Court observed that there can be transfer of title by payment of consideration and delivery of the car. But for the purposes of this Act, the person whose name is reflected in the records of the Registering Authority is the owner. The owner within the meaning of Section 3(30) is liable to compensate. The mandate of the law must be fulfilled.” 1 (2018) 3 SCC 1 2 T.V. Jose v. Chacko P.M., (2001) 8 SCC 748 8 7. Since the appellant was the owner of the offending vehicle on the date of the accident on 16/09/2016 and thereafter, the vehicle was transferred to Thalesh Kumar Sahu on 26/11/2016 (Ex. D/1C), therefore, learned Claims Tribunal has rightly fastened the liability of payment of compensation upon the appellant in light of the decision rendered by the Supreme Court in the matter of Naveen Kumar (supra).
