Petitioner has filed this writ petition seeking following reliefs:- “A. It is prayed, that this Hon’ble Court may kindly be pleased to call for the records relating to the GPF Account of the petitioner, maintained with the respondent authorities. B. It is prayed, this Hon’ble Court may kindly be pleased to quash the impugned recovery notice/order (Annexure P/1). C. Any other relief that this Hon’ble Court may deem fit keeping in mind the facts of this case and in the interest of justice.” 2. Learned counsel for petitioner submits that petitioner while working on the post of Headmaster, Primary School upon attaining the age of superannuation stood retired from service with effect from 31.01.2024. After lapse of long time respondent no. 4 has issued a notice to petitioner mentioning that there is negative balance in his GPF Account ( - 789154.00 ), which is erroneous. 3. Learned counsel for respondent no. 4 would submit that pursuant to the notice Annexuer P-1, respondent no. 4 has asked the petitioner to submit reply/objection if any on the notice mentioning negative balance in his GPF Account, however, petitioner till date has not submitted any objection on the said show cause notice. 4. At this stage, learned counsel for the petitioner submits that after receipt of the notice, petitioner has made an attempt to procure the documents which he received after lapse of long time, therefore, 3 petitioner could not able to submit any reply/objection on the notice issued to him. More so, considering the period as mentioned therein is of two months only. 5. Heard learned counsel for the respective parties. 6. The grievance of petitioner is that respondent no. 4 had issued a notice mentioning negative balance in his GPF Account. Perusal of the notice issued to petitioner would show that it is in the nature of show cause notice, and for the reason as stated above could not submit reply/objection. 7. In the aforementioned facts of the case, I find it appropriate to dispose of this writ petition permitting petitioner to submit reply/objection to the notice issued to petitioner vide Annexure P-1 dated 30.07.2024 by respondent no. 4 within a period of three week’s from today, and in the event petitioner submit reply/objection to the show cause notice dated 30.07.2024, respondent no. 4 is directed to consider the reply/objection on merits and to pass speaking order within a further period of 04 weeks from the date of receipt of the objection/reply. 8. Further learned counsel for respondent no. 4 submits that to consider reply/objection to be submitted by petitioner in lieu of the show cause notice, entire records maintained by the respondent no. 3 will be required, to verify the GPF Account of petitioner and, therefore, respondent no. 3 be directed to send the copies of documents of GPF Account of petitioner maintained by respondent no. 3 to the office of respondent no. 4. 9. In view of the submission made by learned counsel for respondent no. 4, respondent no. 3 is directed to send the copies of documents of 4 GPF Account of petitioner maintained in their office, to respondent no. 4, within a period of four weeks from today. Till decision is taken by the concerned authorities, no recovery proceedings shall be initiated pursuant to the notice/order dated 30.07.2024(Annexure P-1). 10. With the aforesaid direction and observation, this writ petition stands disposed of.
