The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.6 on bail in Crime No.16 of 2023 of Nellore-II SEB Police Station, Nellore SEB District, registered against the Petitioner/Accused No.6 herein for the offences punishable under Section 8(c) read with 20(b)(ii)(C)of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Sri P.Nagendra Reddy, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is a law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Hence, it is urged to allow the petition. 3. Per contra, Mr.A.Sai Rohit, the learned Assistant Public Prosecutor submits that the investigation is not completed. Some more material witnesses are to be examined. The petitioner has indulged in possession and transportation of commercial quantity of Ganja. Hence, it is urged to dismiss the petition. 4. 5. As seen from the record, this is the second bail application filed by the petitioner/Accused No.6. On the earlier occasion, this Court, by order dated 19.06.2026 passed in Crl.P.No.4566 of 2026, dismissed the first bail application filed by the petitioner. The petitioner was arrested on 11.04.2026 and has been in judicial custody for the past 109 days. The charge sheet has not yet been filed. The petitioner has not completed the statutory period of judicial custody to be entitled to default bail. 6.
Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioner/Accused No.6, and in view of the fact that there is no change in the circumstances from the date of dismissal of the first bail application till the filing of the present (second) bail application, this Court is not inclined to enlarge the petitioner/Accused No.6 on bail at this juncture. Hence, this Court finds no merit in the Criminal Petition. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
