The petitioners have filed both petitions seeking following relief(s) : “10.1 This Hon'ble Court may kindly be pleased to call the entire record pertaining to the case of petitioner. 10.2 This Hon'ble Court, after perusal of the record, be pleased to issue a writ in the nature of mandamus directing the respondents to release the pension of the petitioner along with interest. 10.3 Any appropriate writ, direction or order may also kindly be passed in favour of the petitioner, which this Hon’ble Court deems fit in the circumstances of the case.” 2. Learned counsel appearing for the parties jointly submit that the issue involved in both petitions are no longer res integra and both petitions are squarely covered with the judgment passed by this Court in batch of writ petitions leading case of which being WPS No.10696 of 2019 3 parties being Bhagbali Kashyap Vs. State of Chhattisgarh and others which was decided on 14.10.2024. 3. In the light of the submission made herein-above, this Court is of the opinion that both petitions are squarely covered with the judgment rendered by this Court in WPS No.10696 of 2019 decided on 14.10.2024 in case of Bhagbali Kashyap Vs. State of Chhattisgarh and others. 4. Accordingly, both petitions are disposed of in terms of the order passed by this Court in the case of Bhagbali Kashyap (Supra) holding that the judgment passed by the Hon’ble Supreme Court in SLP ( C) No. 8677- 8678/2023 will be applicable mutatis mutandis in the facts and circumstances of the case of the petitioners and their entitlement to get additional pension shall be subject to the decision of Hon’ble Supreme Court in SLP ( C) No. 8677-8678/2023. It is also directed that if SLP ( C ) No. 867-8678 of 2023 is decided in favour of the petitioners, the respondents shall extend the benefit of additional pension to the petitioners without any further delay.
