1. Respondent in H.M.O.P.No.25 of 2026 is the petitioner herein and she filed the present application with a prayer for withdrawal and transfer of the said case from the file of Principal Civil Judge (Senior Division) Court, Narasaraopet to the file of Family Court, Vijayawada. 2. Petitioner is the wife, respondent is her husband and he filed H.M.O.P.No.25 of 2026 with a prayer for dissolution of marriage and for grant of divorce. 3. Present application is filed on the grounds that:- the distance between Vijayawada and Narasaraopet is 100 K.Ms; the petitioner has no financial and physical support to travel and attend the court at Narasaraopet and she has other cases vide F.C.O.P.No.1279 of 2024 before the Judge, Family court at Vijayawada and D.V.C.No.24 of 2025 before the I Additional Chief Metropolitan Magistrate, Vijayawada and she is depending on her parents. 4. The application is opposed by the husband on the ground that he is not earning anything and it is equally difficult for him to attend the Court at Vijayawada. 5. Upon considering the pendency of other cases and the petitioner being lady, claiming the absence of financial and physical support and the

findings and observations of the Hon’ble Apex Court in a case of N.C.V. Aishwarya Vs A.S.Saravana Karthik Sha1 vide para No.9:
"9.
The cardinal principle for exercise of power under Section 24 of the Code of Civil Procedure is that the ends of justice should demand the transfer of the suit, appeal or other proceeding. In matrimonial matters, wherever Courts are called upon to consider the plea of transfer, the Courts have to take into consideration the economic soundness of both the parties, the social strata of the spouses and their behavioural pattern, their standard of life prior to the marriage and subsequent thereto and the circumstances of both the parties in eking out their livelihood and under whose protective umbrella they are seeking their sustenance to life. Given the prevailing socio-economic paradigm in the Indian society, generally, it is the wife's convenience which must be looked at while considering transfer." the prayer in the petition for transfer of the case from the file of learned Principal Civil Judge (Senior Division), Narasaraopet found convincing:-
6. Further, considering the submissions made by both sides that the efforts are being made for settlement, the petition is allowed as follows:- i. The case in HMOP.No.25 of 2026 is withdrawn from the file of Principal Civil Judge (Senior Division), Narasaraopet and transferred to the file of Family Court, Vijaywada. ii. The Principal Civil Judge (Senior Division), Narasaraopet is directed to transmit the case record forthwith, after duly indexed. 1 2022 LiveLaw (SC) 627

iii. Learned Judge, Family Court, Vijayawada is directed to dispose of the case according to law, by giving fair opportunity to both parties, however, after exhausting the possibility of amicable settlement in between the parties, by any of the alternative dispute resolution methods. iv. Learned Judge, Family Court, Vijayawada is directed not to insist the presence of the respondent-husband, unless it is necessary for the purposes like his evidence and conciliation process, if any, and his request for dispense with his appearance may be considered, if, it is on any reasonable grounds. 7. Accordingly, the Transfer, Civil Miscellaneous Petition is allowed. No costs. Consequently, pending miscellaneous applications, if any, shall stand closed.
