Heard Mr. T. Laskar, learned counsel appearing for the petitioners. Also heard Mr. B. Sarma, learned Additional Public Prosecutor, Assam and Mr. D. P. Borah, learned counsel representing the respondent no. 2. By this application filed under Section 482 of the BNSS, 2023, the petitioners, namely, (1) Foiz Uddin; (2) Najim Uddin; (3) Moin Uddin; (4) Jabir Hussain; (5) Md. Sibir Uddin Talukdar @ Shibir Uddin; (6) Suhib Uddin @ Suhaib Uddin; and (7) Mohammed Hilal Uddin @ Hilal Uddin have prayed for pre-arrest bail in connection with Murajhar P.S. Case No. 25/2026. On 16.02.2026, at about 9.30 PM, the respondent no. 2, who is a girl below 18 (eighteen) years of age, was doing her studies, the present petitioners had burst firecrackers near her house causing her disturbance.
The girl came out of the house and asked for not to burst firecrackers in front of her house. On that issue, there was a quarrel. It is alleged that the present petitioners had forced her drag out of her house and tried to put her in a car. During that quarrel, her wearing apparels torn and she got injuries also. Mr. Borah has objected to this bail application on the ground that the petitioners are threatening the respondent no. 2 and if they are allowed to go on bail, they will create problem for the girl. I have gone through the Case Diary. The Case Diary have sufficient incriminating materials against the petitioners Jabir Hussain and Md. Sibir Uddin Talukdar @ Shibir Uddin. For other petitioners, no incriminating materials against them in the Case Diary. Considering entire aspect of the matter, the prayer for pre-arrest bail made in favour of the petitioners Jabir Hussain and Md. Sibir Uddin Talukdar @ Shibir Uddin is rejected. On the other hand, it is hereby directed that in the event of arrest of the petitioners, namely, Foiz Uddin; Najim Uddin; Moin Uddin; Suhib Uddin @ Suhaib Uddin and Mohammed Hilal Uddin @ Hilal Uddin in connection with Murajhar P.S. Case No. 25/2026, the arresting authority shall release them on bail of Rs. 20,000/- each with one surety of like amount to the satisfaction of the arresting authority.
