1 2026:CGHC:4457 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 619 of 2026 1 - Ku. Rani Alias Thageshwari Verma D/o Late Ramkumar Verma, Aged About 18 Years, R/o Mohaba Bazar, Near Tatiband Raipur Railway Line, Police Station- Amanaka, District- Raipur, Chhattisgarh. ... Applicant versus 1 - State Of Chhattisgarh Through Station House Officer, Police Station- Bemetara, District- Bemetara (C.G.). ... Respondent For Applicant : Ms. Madhunisha Singh, Advocate. For Respondent/State : Mr. Tarkeshwar Nande, P.L. Hon'ble Shri Justice Sanjay Kumar Jaiswal Order on Board 27 / 01 / 2026 1. The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023, for releasing him on regular bail during trial in connection with Crime No. 05/2025 registered at Police Station – Bemetara, District –Bemetara (C.G.) for the offence punishable under Sections 296, 351(3), 115(2) of IPC. 2. The prosecution case, in brief, is that on 03.01.2025 at about 10:00 AM, while the complainant, his father, his sister Smt. Pushpa Sahu, and grandmother Smt. Durpati Bai were standing SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.01.27 18:01:50 +0530 2 in front of their house, Topsingh Verma, along with Hira Lal @ Hiru Verma, Kalyan Verma, Somnath Verma, Teeju Verma, Bharat Verma, Ramayan Verma, Rani Verma, Smt. Jamuna Verma, and Smt. Dulaurin Verma, came to their house armed with sticks. Accused Topsingh questioned the complainant as to why he had beaten Hiru the previous day. The complainant denied the allegation. Thereafter, all the accused persons abused the complainant's family in filthy language, threatened to kill them, and jointly assaulted the complainant, his father, and his sister with sticks and fists. When his father attempted to enter the house to save himself, Topsingh, Hiru, Kalyan, and Teeju dragged him outside, and Topsingh inflicted three to four knife blows on the left rib of the deceased. Meanwhile, accused Rani Verma, Hiru, Kalyan, Somnath, Teeju, Bharat, Ramayan, Smt. Jamuna, and Smt. Dulaurin continued beating the complainant and his sister, causing multiple injuries on their heads, neck, hands, back, waist, and thighs. Due to the grievous injuries, the complainant's father became unconscious. He was taken to District Hospital, Bemetara, where the doctor, after examination at 11:05 AM, declared him brought dead. On the basis of the complaint, a crime was registered and investigation commenced. During the investigation, the present applicant and other accused were apprehended. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. It is argued that in the present case, the main accused is Top Singh, who inflicted three to four knife blows on the deceased, and 3 nothing has been seized from the applicant. The evidence collected by the prosecution is prima facie insufficient to establish the applicant's guilt. The applicant is an 18-year-old girl, and she has no criminal antecedents, and has been in jail since 04.01.2025. There is no likelihood of her case being decided in the near future; therefore, the applicant may be released on bail. 4. On the other hand, learned State counsel opposed the bail application, submitting that out of total 27 witnesses, only 5 have been examined till date and several important witnesses remain to be examined, therefore, at this stage, the applicant may not be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record and the evidence against the applicant, further considering the fact that out of 27 witnesses, only 05 have been examined till date, and and some important witnesses are still remaining for examination, at this stage, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 8. However, considering the fact that the applicant is in jail since 04.01.2025 about 01 years 23 days. It is an exceptional case, therefore, concerned trial Court is directed to expedite the trial as early as possible preferably within a period of 05 months. 4 9. Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Sanjay Kumar Jaiswal) Judge Sourabh P.
