Autumn Investment and Infrastructure Limited., which is a private Bank and in the light of the judgment passed by the Hon’ble Apex Court in Civil Appeal Nos.257-259/2022 between Phoenix ARC Private Limited Vs. Vishwa Bharathi Vidya Mandir and others arising out of WP.Nos.35564-35566/2015 dated 27.03.2018, the present writ petition is not maintainable against M/s. Autumn Investment and Infrastructure Limited., which is a private Bank. 2. However on 06.03.2026 when the counsel for the respondent is seeking time to file objections, the matter was directed to be listed on 16.03.2026. Till such time the respondent shall not take any coercive step. When the writ petition is not maintainable before this court, interim protection - 3 - HC-KAR NC: 2026:KHC:17879 WP No. 4151 of 2026 will not be granted. But considering the fact that from 06.03.2026 petitioner is having benefit of an interim order, the same shall continue for another 4 weeks from the date of receipt of the copy of the order. In view of the same, this Court is passing the following: ORDER i. The writ petition is dismissed as not maintainable. ii. The petitioner is at liberty to avail the appropriate remedy before the DRT. iii. The interim protection that is granted on 16.03.2026 shall remain in force for a period of four weeks from the date of receipt of the copy of the order. iv.
