The petitioner is apprehending his arrest in connection with Birni P.S. Case No.208 of 2025, registered for the offence under Sections 126(2), 127(1), 115(2), 118(2), 109(1), 76, 74, 351(2), 352, 3(5) of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Giridih. 3. Learned counsel appearing for the petitioner submits that the scuffle took place due to land dispute. He further submits that the allegation is made of assault by sword, however, in the injury report it has come that the injury has been received due to hard and blunt substance. He next submits that the alleged occurrence is said to be dated 24.07.2025, whereas, injury report is of 04.08.2025 that too of a private hospital, which has been disclosed in the case diary. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegation of assault is there and the injury has also been received. 5. In the FIR, it has been stated that the assault has been made on head, whereas, in the injury report it has come that the injury has been received ( 2026:JHHC:11748 ) -2- A.B.A. No. 6927 of 2025 on hand that too due to hard and blunt substance and further the injury report is of 04.08.2025 issued by a private hospital, whereas, the alleged occurrence is said to be on 24.07.2025 and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
