06.04.2026 Sl. No.38 NB CRM (A) 1017 of 2026 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Samserganj PS Case No.275/2025 dated 16.04.2025 under Sections 191(2)/191(3)/190/329(4)/324(4)/326(g)/109 of the BNS, 2023. And In the matter of: Sohidul Sk @ Sadikul Sk @ Sadekul Hosen & Ors. … petitioners Mr. Kusal Kumar Mukherjee, Mr. Arijit Bose. …for the petitioners. Ms. Sreyashee Biswas, Mr. Dipankar Paramanick. ..for the State. Heard the learned counsels for the parties. Perused the case diary. The prosecution case is that the petitioner and others had forcibly entered the grocery shop of the victims, assaulted them and looted articles. An eye-witness/victim has taken the name of the petitioners as some of the assailants/eye-witness in a statement before the learned Magistrate. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the present petitioners. The application for anticipatory bail of the petitioners is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.) 2
