BEFORE HON'BLE MR. JUSTICE ROBIN PHUKAN ORDER 29.05.2026 Heard Ms. L. Sharma, learned counsel for the applicant and also heard Mr. S. Chauhan, learned counsel appearing for the respondent/opposite party No.1.
Page No.# 2/2 This interlocutory application under Section 5 of the Limitation Act is preferred by the applicant for condonation of delay of 2(two) days in preferring the connected appeal against the judgment and award dated 29.10.2025, passed by the learned Member, Motor Accident Claims Tribunal, Udalguri, in MAC Case No.6/2023. Ms. Sharma submits that due to procedural formalities and administrative step required within the applicant's organization, the appeal could not be filed in time and the delay is not intentional or due to negligence or laches on the part of the applicant and as such, she has contended to condone the same. Mr. Chauhan, learned counsel for the opposite party No.1 submits that he has no objection. Accordingly, taking note of the submission of learned counsel for both the parties and also considering the explanation so forthcoming for the delay of 2(two) days, this Court is of the view that the delay is sufficiently explained and accordingly, the same stands condoned. In terms of above, the I.A. stands disposed of. Now the Registry to register and number the connected appeal and list the same before the Court as soon as practicable. Mr. Chauhan submits that he has not been furnished with a copy of the memo of appeal. Ms. Sharma undertakes to furnish a copy of the same to Mr. Chauhan during the course of the day.
