The petitioner alleges that the private respondents have raised an unauthorised construction by encroaching upon a portion of the PWD road. The learned Advocates for the State and the private respondents uniformly submit that the petitioner has not specified the plot number belonging to the Public Works Department. They further submit that the representation submitted by the petitioner before the authority is also silent in that regard. Mr. Dalapati, learned Counsel for the private respondents submits that in the representation the petitioner has also not disclosed the plot number where he is residing. Faced with such situation, Mr. Bhattacharya, learned Advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to file a comprehensive representation before the concerned authority ventilating the grievance. In the light of the submission made by Mr. Bhattacharya, this writ petition stands dismissed as withdrawn with liberty to the petitioner to make a comprehensive representation before the appropriate authority ventilating the grievance.
