Mr. Rohit Kumar, Advocate, i/b Mr. Ishwari Datt Paliwal, Standing Counsel for the respondent no. 5. (2) Petitioner is resident of District Saharanpur in the State of Uttar Pradesh. According to petitioner, he is a transport operator, who was granted permanent Stage Carriage Permit for Saharanpur- Vikasnagar route, before State reorganisation. Grievance raised by the petitioner is that Secretary, State Transport Authority, Dehradun is not countersigning the Stage Carriage Permit, due to which he is unable to ply the vehicle on the portion which falls within the territorial limits of State of Uttarakhand. By means of this writ petition, petitioner has sought the following relief: “i. Issue writ order or direction in the nature of mandamus directing the respondent no. 4 to take appropriate decision on the application dated 16.04.2025 moved by the petitioner’s Union before the Secretary, State Transport Authority, Uttarakhand, Dehradun (Annexure No. 6 Page No. 72 To 73 to the writ petition) within a stipulated time period which this Hon’ble Court may deem fit and proper on the facts and circumstances of the case.” (3) Mr. Yogesh Pandey, learned State Counsel, was asked to get instructions. On instructions, he submits that a reciprocal agreement was entered into between State 2026:UHC:4859 of U.P. and State of Uttarakhand and, as per that agreement, 93 Stage Carriage Permits were to be granted for the aforesaid route, however there are as many as 96 transport operators who have applied for the said route. He thus submits that because applications are received in excess of permissible limit, therefore the State Transport Authority is issuing temporary permits to the transport operators. (4) Learned Counsel for the petitioner submits that petitioner be permitted to make representation. (5) Writ petition is, accordingly, disposed of with liberty to petitioner to make representation to Secretary, State Transport Authority. If he makes representation within two weeks, decision thereupon shall be taken, as per law, within eight weeks thereafter. It is made clear that petitioner shall not espouse cause of any association or union of transport operators in his representation and he shall make the representation in his individual capacity.
