……for the NCB. Learned advocate appearing for the petitioner submits that the petitioner was arrested on 7th February, 2025 and is in custody. It has also been contended that the co-accused from whom recovery of 1344 Kgs. of Ganja were seized has been granted bail on 23.07.2024 in CRM (NDPS) 1060 of 2024. Learned advocate for the NCB opposes the prayer for bail and submits that petitioner was absconding for a considerable period of time and the accusations against him is that he is the supplier. It has been further contended that there are call data records appearing against the present petitioner and the petitioner was arrested on the basis of execution of the warrant of arrest. 2
Be that as it may, petitioner was absconding for a considerable period of time. Other accused persons are also absconding and dates have been fixed for issuance of proclamation and attachment. Having regard to the fact that case was registered in the year 2021, more than 4 and a half years have passed since the registration of the case and for absence of the accused persons the case is being delayed, I direct that the learned Special Court would complete the process of law so far as tracing out the other accused persons are concerned. If the other accused persons are not traceable, the learned Trail Court would split up the trial. The said process be completed within a period of 2 months from the next date so fixed. Learned Special Court would thereafter proceed for the stage of consideration of charges. Petitioner be released on bail after the stage of consideration of charges are over. With the aforesaid observations CRM (NDPS) 527 of 2026 is disposed of. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
