Respondents herein, in withholding the payment of LS 4th and Part Bill Gross Rs. 2,23,43,321/- in Net Amount of Rs. 2,07,76,232/- and LS and Final Bill Gross Rs. 2,11,09,707/- in Net Amount of Rs. 1,54,00163/- (Total Gross Rs. 4,34,53,028/- and Total Net Rs. 3,61,76,395/-) the petitioner in relation to the work i.e., Widening and Strengthening of a) Gopalapuram - Ganti Road (via) M.V Padu from km 0.00 to 4.725, B) Km 0/4 of Janakammaravi Road to Pushkar Ghat Road (via) C.R.C and Chinnavantana, Branch road No.l NH 16 Ravulapalem to Komaraju Lanka Road and Branch Road No.II Janakammaravi Road to NH16 (Kapulakalyana Mandapam) from km 0.000 to 6.450 in East Godavari District C) Janakammavari - Ravulapalem Road (via) Kapulakalyan Mandapam and Adilakshimi Punta from km 0.000 to 6.500 in East after finalizing the bills payable to even Godavari District as per the L.S Agreement CR No. 74/2022-2023, Dt.31.03.2023 is questioned, as the same is illegal, arbitrary and violative of Articles 14, 16, 19 and 300-A of Constitution of India and consequently direct the respondents to consider for payment of LS 4th and Part Bill Gross Rs. 2,23,43,321/- in Net Amount of Rs. 2,07,76,232/- and LS 5th and Final Bill Gross Rs. 2,11,09,707/- in Net Amount of 1,54,00163/- (Total Gross Rs. 4,34,53,028/- and Total Net Rs. 3,61,76,395/-) with an interest @24percent per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to DIRECT the respondents to consider for payment of LS 4th & Part Bill Gross Rs. 2,23,43,321/- in Net Amount of Rs. 2,07,76,232/- and LS 5th and Final Bill Gross Rs.
