JUSTICE M.I.ARUN ORAL ORDER On the allegation that respondent No.2 is putting up construction in violation of the law, the petitioner has complained to respondent No.1 - Panchayat. As no action was initiated against respondent No.2 by respondent No.1 - Panchayat, the present petition is filed with a prayer to direct respondent No.1 to initiate appropriate action against respondent No.2. 2. The learned counsel appearing for respondent No.1 - Panchayat, upon instructions, submits that, pursuant to the complaint received from the petitioner, suitable action has been initiated against respondent No.2 and the same will be taken to its logical end. - 3 - HC-KAR NC: 2026:KHC:22250 WP No. 24768 of 2025 3. The learned counsel appearing for the petitioner submits that he is satisfied with the action initiated by respondent No.1. 4. However, the learned counsel appearing for respondent No.2 submits that she is putting up construction only in the manner known to law and that the petitioner is a stranger to the property. He further submits that, at the behest of the petitioner, respondent No.1 has initiated action illegally against respondent No.2 and respondent No.2 intends to challenge the action initiated by respondent No.1 in the manner known to law. Hence, the following: ORDER i. As respondent No.1 has initiated action against respondent No.2 as desired by the petitioner, the Writ Petition is hereby dismissed as having become infructuous. - 4 - HC-KAR NC: 2026:KHC:22250 WP No. 24768 of 2025 ii. It is needless to state that if respondent No.2 is of the opinion that the action initiated by respondent No.1 is not in accordance with law, she is always at liberty to challenge the same in the manner known to law.
