The petitioner is apprehending his arrest in connection with Cyber P.S. Case No. 282 of 2025, registered for the offence under Sections 318(4), 319(2), 336(3), 338 of the Bharatiya Nyaya Sanhita, 2023 and Section 66(c) and 66(d) of I.T. Act, pending in the Court of the learned Special Judge, Cyber, Ranchi.

Learned counsel appearing for the petitioner submits that the petitioner and his wife themselves are victims, whose stolen mobile phone and ATM card were misused by unknown offenders to commit the alleged cyber offence. She also submits that the wife of this petitioner has already been provided the privilege of anticipatory bail by this court in A.B.A. No. 846 of 2026. She next submits that this petitioner is ex-serviceman and at present he is working at BPCL, Kopara. She further submits that the petitioner is having no criminal antecedent, as disclosed in paragraph-20 of this petition. He next submits that with regard to the theft of mobile phone and ATM Card and account of the petitioner along with her husband utilized by the

cyber-criminal, Sanha was also lodged by the petitioner, contained in annexure-5 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that in course of investigation, the name of the petitioner has surfaced.

Considering that Sanha has been lodged by the petitioner as his account has been used by the cyber-criminal and the petitioner is not named in the FIR and it has been pointed out that from the account of the petitioner, an amount of Rs.3,98,000/- has also been siphoned away by the cybercriminal and the petitioner has got no criminal antecedent and further the wife of this petitioner has already been provided the privilege of anticipatory bail in the aforementioned A.B.A. and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Cyber, Ranchi in connection with Cyber P.S. Case No.282 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
