The present criminal miscellaneous petition has been filed by the petitioner under Section 528 of BNSS, 2023, seeking quashing of FIR No.0134/2026 dated 29.03.2026 registered at Police Station Shyam Nagar, District Jaipur City (South) for the alleged offences punishable under Sections 115(2), 126(2), 352 and 3(5) of BNS, 2023 and Section 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2. Learned counsel for the petitioner, at the very outset, submits that as the parties have arrived at a compromise, the FIR in question is liable to be quashed in view of the judgments passed by the Hon’ble Supreme Court in Gian Singh Vs. State of [2026:RJ-JP:19020] (2 of 3) [CRLMP-2273/2026] Punjab and Another, JT 2012 (9) SC-426 and Narinder Singh & Others Vs. State of Punjab and Another, 2014 Cr.L.R. (SC) 35. 3. Learned Public Prosecutor has opposed the aforesaid prayer whereas, the learned counsel for the complainant acknowledging the factum of compromise entered into between the parties, submits that the complainant has no objection if the FIR in question is quashed. 4. Heard learned counsel for the parties and perused the material available on record. 5. In pursuance to the order dated 15.04.2026 passed by this Court, the parties have duly appeared before the Investigating Officer and in regard to the same, a report dated 29.04.2026 has been submitted by the Investigating Officer, which confirms the factum of compromise being entered into between the parties. The said status report dated 29.04.2026 submitted by the Investigating Officer is taken on record. 6. Undisputedly, the controversy involved in the present case arises out of an incident between the parties, which has now been amicably settled. The complainant has no subsisting grievance against the petitioner. Further, considering the nature of allegations and the attendant circumstances, continuation of criminal proceedings would not serve any purpose and would amount to abuse of the process of law. 7. In view of the compromise and the law laid down by the Hon’ble Supreme Court in Gian Singh (supra) and Narinder Singh (supra), this Court deems it just and proper to quash the FIR in question.
