PUBLIC PROSECUTOR The Court made the following: ORDER: The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioners / Accused Nos.1, 5 to 7, in connection with Crime No.166 of 2025 2 on the file of G.D.Nellore Urban Police Station, which is registered for the offences under Sections 109(1), 118(1) and 351(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. Heard Ms.Y.Mahalakshmi, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for State / Respondent. 3. Learned counsel for the Petitioners would submit that there are no specific allegations against the Petitioners and the Petitioners are falsely implicated in the present crime. Learned counsel would further submit that the de facto complainant and the Accused are close relatives and there are civil disputes between the parties. It is further submitted that the Petitioners are also victims in the hands of the de facto complainant and his family members, however, by influencing the Police, the present crime has been registered against the Petitioners. It is submitted that there are no grievous injuries to the de facto complainant. Hence, prayed to grant anticipatory to the Petitioners. 4. Learned Assistant Public Prosecutor would submit that there are specific allegations against the Petitioners. It is submitted that the investigation is at the nascent stage. It is further submitted that Section 118(1) of BNS has been altered to Section 118(2) of BNS. It is further submitted that, there are no grounds to grant anticipatory bail to the Petitioners at this stage. Hence, prayed for dismissal of the petition. 3 5. Considering the submissions made and a bare perusal of the material placed on record would show that, as rightly put by the learned Assistant Public Prosecutor, prim facie there are specific allegations against the Petitioners and the Section of law was altered from Section 118(1) BNS to Section 118(2) of BNS . The investigation is at a preliminary stage and the nature of the accusations does not warrant the grant of anticipatory bail at this stage. Accordingly, this Court is not inclined to grant anticipatory bail to the Petitioners. 6. In the result, the Criminal Petition is dismissed.
