Mr. Mohd. Safdar, Advocate, for the petitioner. Mr. Tarun Lakhera, Brief Holder, for the State. (2) According to petitioner, during consolidation proceedings, he was allotted chaks, however chack road has not been provided to him, due to which he is facing great difficulty in having access to his chaks. (3) Learned Counsel for the petitioner refers to a letter, issued by the O/o District Magistrate, Hardiwar to Administrative Officer, Uttarakhand Human Rights Commission on 21.5.2020. Based on the said document, it is contended that because of some dispute pending before Settlement Officer of Consolidation, regarding the land over which chak road was to be given, chak road was not provided. He submits that the dispute pending before Settlement Officer of Consolidation has, however, now been decided and there is no legal impediment in providing chak road to the petitioner. (4) Learned State Counsel submits that petitioner has made representation to the District Magistrate, who also happens to be Deputy Director (Consolidation), therefore the District Magistrate shall pass necessary order after examining the matter. (5) Writ petition is, accordingly, disposed of with a direction to District Magistrate, Haridwar to take decision on petitioner’s representation dated 6.5.2025, 2026:UHC:4769 Annexure-5 to the writ petition, as early as possible, but not later than four months from the date of presentation of certified copy of this order. Other persons having interest in the matter shall also be given opportunity of hearing by the District Magistrate before taking any decision in the matter.
