The petitioner is apprehending his arrest in connection with Gumla P.S. Case No.168/2025, registered for the offence under Sections 27(b)(ii) of Drugs and Cosmetics Act, 1940 and under Section 21/21(c)/22(b) of N.D.P.S. Act, pending in the Court of the learned Sessions Judge, Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the seized cough syrup and other medicines. He further submits that the said articles have been recovered from the roof of the toilet, which is situated outside of the house of the petitioner. He then submits that the name of the petitioner has come only on suspicion. He next submits that the petitioner is having ailments. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that Onrex cough syrup 100 ml. quantity 120 bottles, Winspasmo Forte Capsule quantity 864 capsules, Nitrosun-10 tablets quantity 60 tablets have been recovered from the roof of the toilet. He further submits that the name of the petitioner has been taken by the co-accused and the said ( 2026:JHHC:11803 ) -2- A.B.A. No. 6963 of 2025 quantity is commercial. On these grounds, he submits that anticipatory bail may not be granted to the petitioner. 5. In view of the above and considering that Onrex cough syrup 100 ml. quantity 120 bottles, Winspasmo Forte Capsule quantity 864 capsules, Nitrosun-10 tablets quantity 60 tablets have been recovered from the rooftop of the washroom of the petitioner and the said quantity is commercial and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected. 6.
