Mr. Vishesh Srivastava, Advocate, for the petitioner. Mr. Devendra Pant, Standing Counsel, for the State. (2) By means of this writ petition, petitioner has sought the following relief: “I. Issue a writ order or direction in the nature of mandamus commanding the respondent no. 3 to decide the representation dated 19.03.2026 in accordance with the law and filed by the petitioner annexed as (Annexure No. 8 Page No. 42-44) and complete the task of handing over the physical possession of the property in question to the petitioner financial institution with the assistance of the respondent no. 2 & 3 expeditiously within a shortest period prescribed by the Hon’ble Court.” (3) Petitioner is a non-banking financial institution, which reportedly sanctioned loan to one Mr. Avinash Kapoor. Since the loan was not repaid by the borrower, therefore, petitioner approached District Magistrate, Dehradun by moving application under Section 14 of SARFAESI Act. District Magistrate reportedly passed an order on 7.1.2023 on that application and petitioner thereafter deposited necessary fee before the police authorities, but thereafter no progress has been made. (4) After arguing for a while, learned Counsel for the petitioner submits that petitioner has made a representation on 19.3.2026, therefore concerned authority be directed to take decision on the said representation. (5) Writ petition is, accordingly, 2026:UHC:4798 disposed of with a direction to authority concerned to take decision on petitioner’s representation, as per law, within two months from the date of presentation of certified copy of this order.
