1. The petitioner seeks compassionate appointment. His father was employed with the West Bengal Transport Corporation (formerly known as the Calcutta Tramways Company (1978) Limited). He died- in-harness on 15th November, 2022. Application seeking compassionate appointment was made by the petitioner immediately thereafter. The same has not been considered till date.
2. Prayer has been made to direct the authority to consider the petitioner’s prayer for compassionate appointment.
3. Learned advocate representing the West Bengal Transport Corporation submits, upon instruction, that there is no scheme for providing
2 compassionate appointment in respect of State Transport undertakings.
4. Be that as it may, since an application has been filed by the petitioner seeking compassionate appointment, the authority ought not to have kept it pending for an indefinite period and should have considered and disposed of the said application.
5. In view of the above, the instant writ petition stands disposed of by directing the respondent no.5, being the Managing Director, West Bengal Transport Corporation, to take a decision on the petitioner’s prayer seeking compassionate appointment strictly in accordance with the prevailing scheme and intimate the fate of the petitioner’s application to him at the earliest but positively within a period of eight weeks from the date of communication of this order.
6. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
