Apprehending his arrest in connection with FIR No.08/2025, registered with Police Station Special Police Station (SOG), ATS and SOG Jaipur for the offences under Sections 420, 467, 468, 471 and 120-B of IPC and Section 3, 4 and 6 of the Rajasthan Public Examination (Prevention of Unfair Means) Act, 1992 and Section 66 of I.T. Act, the accused-petitioner has preferred this criminal miscellaneous bail application under Section 482 of B.N.S.S.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the petitioner was granted interim protection vide
order dated 06.05.2026. It is further contended that there is no accusation to the effect that the petitioner manipulated the OMR sheet for the examination conducted by the Rajasthan

The main allegations of manipulating the OMR sheet are against the other co-accused namely, Shardan Khan, Ram Pravesh Singh and Vinod Kumar Gaur and they have already been arrested. It is further contended that the accused-petitioner appeared before the Investigating Agency on 06.05.2026 and after interrogating the petitioner, the Investigating Agency did not find it necessary to arrest him. The petitioner also appeared before the Investigating Officer as per the directions of this Court passed on 06.05.2026, the petitioner is ready and willing to cooperate with the investigation, custodial interrogation of the accused-petitioner is not required, therefore, his anticipatory bail application may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application and submitted the factual report. 4. Heard and perused material available on record. 5. In the factual report, it is stated that the petitioner appeared before the Investigating Agency and the Investigating Agency interrogated him. It is alleged against the petitioner that he changed the OMR sheet, however, the Investigating Officer has not taken the specimen signature of the petitioner when the petitioner was interrogated. It is also stated that the Investigating Officer has not cited any reason for custodial interrogation, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to allow the anticipatory bail application of the accused-petitioner. 6.
Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioner- Dheeraj Kumar Singh S/o Shri
[2026:RJ-JP:21653] (3 of 3) [CRLMB-2724/2026] Chandra Prakash Singh, in connection with FIR No.08/2025, registered with Police Station Special Police Station (SOG), ATS and SOG Jaipur, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court. (iv) that the petitioner would submit his Mobile phone and Sim Card before the concerned Investigating Officer. (v) that the petitioner would submit his contact details along with the present address to the concerned Investigating Officer. In case if the petitioner changes his address or mobile number, he shall submit the same before the concerned Investigating Officer. (PRAVEER BHATNAGAR),J Ashwani Kr Srivastava/-103
