The instant petition has been filed under section 528 of the B.N.S.S, 2023 (earlier section 482 of the Cr. P.C) for restoration of Cr. M.P No.3698 of 2022 to its original file which was dismissed for non-prosecution on 11.07.2025. 2. The reason has been assigned in the instant petition for restoration that the counsel for the petitioner was suffering from eyes problem and to that effect the medical prescription has been appended. 3. It has been submitted that due to non-appearance of the learned counsel for the petitioner on 11.07.2025, Cr. M.P No.3698 of 2022 was dismissed for non-prosecution. It has been submitted that if Cr. M.P. No.3698 of 2022 is not restored to its original file, the petitioner will suffer irreparable loss and injury. 2026:JHHC:11699 2 4. Mr. Shailendra Kumar Tiwari, the learned Spl.PP has appeared on behalf of the opposite party-State and raised no objection, rather a statement has been made that the instant petition for restoration may be allowed so that Cr. M.P No.3698 of 2022 may be decided on its own merit. 5. Considering such submission and after being satisfied with the cause shown in the instant petition, the petition for restoration is allowed and Cr.
