Supriya Das -vs- The State of West Bengal Mr. Sourav Mondal Mr. Subhajit Chowdhury Mr. Arijit Bhuiya Mr. Rony Mondal Mr. Debarghyo Sil … for the petitioner In this application petitioner has prayed for a direction upon the court below for expeditious disposal of the Session Case being ST1 (7) of 2017 arising out of Dumdum Police Station Case No. 1058/2016 presently pending before learned Court of Additional Session Judge, 2nd Court, Barrackpore. Learned counsel for the petitioner submits that the FIR was lodged in the year 2016 and after completion of investigation the charge-sheet was submitted on 14th February, 2017. Prosecution proposes to examine ten witnesses as appearing in the charge- sheet. However, so far prosecution could examine only eight witnesses and therefore he seeks for a direction upon the court below for expeditious disposal of the case. Having heard learned counsel for the petitioner, and that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice, service of copy of application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner and that the case is pending for about ten years, I find that the prayer made 2 on behalf of the petitioner is justified and is required to be allowed for the ends of justice. In view of the above, the instant application being CRR 644 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the aforesaid Sessions Trial Case No. ST1(7) 2017 and to make his best efforts to conclude the trial preferably within a period of six months from the next date of hearing, without granting any unnecessary adjournment to either of the parties.
