1. This suspension of sentence application has been filed by the accused-applicants along with the appeal. [2026:RJ-JP:20402-DB] (2 of 3) [SOSA-515/2026]
2. Learned Senior Counsel appearing on behalf of the accused- applicants submits that the accused-applicants have been convicted for the offences under Sections 148, 307/149 & 302/149. 3. Learned Senior Counsel for the accused-applicants submits that the accused-applicants namely Kumarr Singh, Lekhraj & Hariom were on bail during trial and accused-applicant namely Jogendra Singh was not on bail during trial and presently, all the accused-applicants are serving their sentence in District Jail, Karauli. He further submits that the accused-applicants have been falsely implicated in this matter and according to the statement of the eye witnesses, allegation of causing fire arm injury is against co-accused persons namely Rajendra and Gajraj. He further submits that the appeal is not likely to be heard in near future and prayed that sentence awarded to the accused-applicants may be suspended and they be released on bail during the pendency of the appeal. 4. Learned Government Advocate-cum-Additional Advocate General assisted by learned counsel for the complainant has opposed the application for suspension of sentence. 6. We have heard learned counsel for the parties and perused the record. 7.
Considering the facts and circumstances of the present case, and also considering the evidence of eye witnesses, according to which, the allegation of causing fire arm injury is against co- accused persons namely Rajendra and Gajraj and the fact that hearing of appeal may take long time, we deem it just and proper

In that view of the matter, this criminal miscellaneous suspension of sentence application is allowed and it is ordered that execution of sentence awarded to the accused-applicants shall remain suspended during the pendency of the criminal appeal and the accused-applicants be admitted to bail subject to satisfaction of the trial Court with the stipulation that he shall appear before this Court on 10.07.2026 and thereafter as and when called upon to do so. 9.
