2. By means of this writ petition, petitioner has sought the following relief:
“Issue a writ, order or direction in the nature of Mandamus thereby directing the Respondent No. 1 to expunge the mutation entries made in the revenue record (Annexure No. 2 to the writ petition page no. -- 14-15-), being void ab initio and without legal effect on the basis of the impugned gift deed dated 31-01-2005 in favor of H. E. the Governor and Uttaranchal Zila Yuva Kalyan Adhikari, Pithoragarh and restore the donors names therein.”
3. Learned State Counsel, however, submits that relief as claimed by petitioner cannot be granted in proceeding under Article 226 of Constitution of India. He submits that petitioner executed a gift deed in favour of State Government in respect of 20 nali land and now petitioner is reclaiming that land which was gifted by him.

Learned counsel for the petitioner, however, submits that gift deed executed by petitioner was void ab initio, therefore petitioner is still the owner of the land.
5. This Court is not inclined to go into the
2026:UHC:4800 issue raised in the writ petition.

Learned counsel for the petitioner after arguing for a while submits that petitioner has made a representation to the Collector, who may be asked to take decision in the matter.
7. Learned State Counsel submits that he has no objection if writ petition is disposed of in terms of prayer made by petitioner’s counsel.
8. The writ petition is, accordingly, disposed of with a direction to Collector, Pithoragarh to consider petitioner’s representation and take decision strictly, as per law, within eight weeks from date of presentation of certified copy of this order.
