Mr. Abhishek Verma, Advocate, for the petitioner. None for the respondent. (2) Petitioner has challenged order dated 1.4.2026, passed in O.S. No. 77 of 2026. By the said order, notice was issued on temporary injunction application filed by the petitioner, fixing 2.5.2026. Learned Counsel for the petitioner submits that next fixed in the matter is 8.7.2026. (3) Learned Counsel for the petitioner contends that having regard to the facts and circumstances of the case, Trial Court ought to have passed ex parte temporary injunction in favour of the petitioner. (4) This Court is not impressed by the said submission. The course adopted by learned Trial Court is strictly as per law. As per relevant provision of CPC, issuance of notice is rule and grant of temporary injunction without issuing notice is exception. Thus there is no scope for interference in the matter. Writ petition, however, is disposed of with a request to the Trial Court to consider petitioner’s temporary injunction application on the next date fixed, provided all the respondents are served.
