CRL.M.C. 1726/2026 By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners and complainant/respondent No. 2 seek quashing of case FIR No. 146/2024 dated 28.03.2024 registered under section 63 of the Copyright Act, 1957 at P.S.: Uttam Nagar, Dwarka, Delhi. 2. The FIR has been registered on the allegation that the petitioners have infringed the copyright (IPR) of M/s. Spigen India Pvt. Ltd.; and the settlement comprised in Memorandum of Understanding dated 19.02.2026 (‘MoU’) contemplates that the petitioners would pay to respondent No. 2 compensation of Rs. 4 lacs and also furnish an This is a digitally signed order. Respondent No. 2 is represented by Mr. Rinku Dabra, Manager – HR, Legal & Business Excellence, who has been authorized to enter into the compromise vide Resolution dated 17.02.2026 of the Board of Directors of the company, a copy of which is appended to the petition. 4. The petition is also supported by affidavits of the petitioners and of respondent No. 2, alongwith proof of their IDs. 5. The contesting parties are present in court. Their credentials have been verified and they have also been identified by their respective counsel. 6. The court has interacted with respondent No.2, as also with petitioners, who have confirmed that they have now resolved the matter and MoU dated 19.02.2026 has been signed by them closing all issues amicably. Parties now wish to live in peace and harmony going forward. 7. Respondent No. 2 also confirms that in terms of the MoU, they have received the sum of Rs. 4,00,000/- (Rs. Four Lacs Only) from the petitioners. 8. Ms. Richa Dhawan, learned APP confirms that the State has no objection to the subject FIR being quashed. 9. In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be This is a digitally signed order.
