Mr. Harsh Vardhan Dhanik, learned counsel for the petitioners. 2. Mr. S.K. Nailwal, learned Standing Counsel for the State of Uttarakhand. 3. By means of this writ petition, petitioners have sought the following reliefs:- (i) A writ order or direction in the nature of certiorari quashing the impugned termination of petitioners by respondent no. 2. (ii) A writ or direction in the nature of mandamus directing the respondent no. 3 to reinstate the petitioner. (iii) A writ or direction in the nature of mandamus directing the respondent no. 3 to pay all pending salary and employment benefits of the petitioner to the livelihood of petitioners. (iv) A writ or direction in the nature of mandamus directing the respondent no. 2 to take proper legal action against the petitioner no. 3 in accordance with law. (v) Issue any other writ, order or direction, which this Hon’ble Court may deem fit and proper under the facts and circumstance e of the case. 4. Learned State Counsel submits that petitioners were allegedly employees of M/s Sheel Chandra Agro Oil Pvt. Ltd., which is a private company with no State Funding, therefore, writ petition would not be maintainable. 5. Learned counsel for the petitioners submits that petitioners have made representation to Assistant Labour 2026:UHC:4867 Commissioner, Rudrapur, District Udham Singh Nagar who may be directed to take decision thereupon. 6. Having regard to the facts of the case, the writ petition is disposed of with liberty to petitioners to make fresh representation to Assistant Labour Commissioner. If they make such representation within three weeks from today, Assistant Labour Commissioner shall examine the issue and pass necessary order, as per law, within eight weeks thereafter.
