D/L.09. March 24, 2026. KAUSHIK WPA No. 32096 of 2014 WBSEDCL Vs. Afroja Bibi & Ors. Mr. Srijan Nayak Ms. Rituparna Maitra … for the petitioner/WBSEDCL Mr. Raja Saha Mr. Sanjoy Mukherjee … for the Ombudsman The grievance of the petitioner is directed against an order passed by the Ombudsman dated 6th June, 2014 in case no. GR-1860 KB of 2013. By the impugned order, the Ombudsman has granted compensation against WBSEDCL on the ground of alleged delay in issuing an quotation for a period from 26th July, 2013 to 17th September, 2013 at the rate of Rs.500/- per day in terms of Regulation 15 of 2010 Regulation. It is submitted on behalf of the petitioner that in passing the impugned order, the Ombudsman has not taken any note of the fact that the relevant 2010 Regulation was amended by Regulation 57 with effect from August, 2013. It is further submitted on behalf of the petitioner that the impugned order is unreasoned and is liable to be set aside. There has been no adjudication on the issue by the concerned 2 Ombudsman as mandated under Sections 143 and 144 of the Electricity Act, 2003. An adjournment is prayed for on behalf of the respondent-Ombudsman. The matter has been repeatedly adjourned on various occasions. It is made clear that no further adjournment would be granted to either of the parties. Let this matter appear on 9 April, 2026. (Ravi Krishan Kapur, J.)
