Kausik (Allowed) CRM (M) 530 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with New Barrackpore Police Station Case No. 295 of 2023 dated 14.11.2023 under sections 420/406/413/467/468/471/120B of the Indian Penal Code. PP Ms. Subhasree Patel Mr. Subhasish Datta ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 4 months. Charge sheet has been submitted where the prosecution has relied upon 23 witnesses. Till date one witness has been examined and prayer for further investigation is pending. Learned Public Prosecutor opposes the prayer for bail and submits that there are 5 other cases of similar nature pending against the petitioner at different police stations including at New Delhi Cyber Crime Police Station. 2 Having considered that there is no possibility of the trial concluding in near future, without entering into the merits of the case, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Anuj Kumar Shaw shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Barrackpore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the Learned Trial Court. Petitioner shall also make himself available as and when called for by the Officer-in-Charge, New Barrackpore Police Station. With the aforesaid observations CRM (M) 530 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
