JUSTICE ROBIN PHUKAN ORDER Date : 27.05.2026 Heard Mr. A.K. Azad, learned counsel for the applicant. Also heard Mr. K.K. Bhatta, learned counsel for the opposite party No. 1; and Ms. A.B. Kayastha, learned counsel for the opposite party Nos. 2 and 3. 2. In this interlocutory application, under Section 151 of the CPC, the applicant has prayed for directing the Registry of this Court to release 50% of the awarded amount deposited before it, in view of the order dated 01.08.2025, passed in I.A.(Civil) No. 2405/2025. 3. Mr. Azad, learned counsel for the applicant submits that pursuant to the order dated 01.08.2025, passed in I.A.(Civil) No. 2405/2025, the opposite party No. 1 has deposited 50% of the awarded amount before the Registry of this Court and that the applicant is willing to withdraw the same from the Registry, and therefore, he has contended to issue direction to the Registry to release the said amount in favour of the applicant. 4. Mr. K.K. Bhatta, learned counsel for the opposite party No. 1; and Ms. A.B. Kayastha, learned counsel for the opposite party Nos. 2 and 3 submit that they have no objection in the event of allowing this application. 5. Accordingly, taking note of the submissions of learned counsel for both the parties, this Court is inclined to allow this application. Registry is directed to release 50% of the awarded amount in favour of the applicant on proper identification. Page No.# 3/3 6. In terms of above, this I.A. stands disposed of.
