GP FOR SERVICES I The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY Writ Petition No. 19689 of 2026 ORDER: The Writ Petition is filed being aggrieved by the action of the Respondents in not effecting promotion to the Petitioner to the post of Gazetted Food Inspector on the basis of the final seniority list dated 03.06.2026, despite the Petitioner having filed an appeal therefrom as provided under Rule 26 of the AP State and Subordinate Service Rules, as illegal and arbitrary. 2. The brief facts of the case for filing the present Writ Petition are as follows: The Petitioner was promoted to the post of Food Safety Officer from the post of Junior Assistant vide Proceedings dated 25.05.2021, and the Petitioner had successfully completed his probation vide Proceedings dated 24.09.2020 in the said post. A provisional seniority list in the cadre of Food Safety Officer was issued, and the Petitioner had submitted his objections thereto. However, without considering the objections and without assigning any reasons, the final seniority list was issued on 03.06.2026 by Respondent No. 2. Questioning the same, the Petitioner filed an appeal before Respondent No. 1 on 09.07.2026, and the same is pending consideration. Hence, the present Writ Petition. 3 3. The grievance of the Petitioner now is that even though the appeal filed by the Petitioner is pending, promotions are being effected to the post of Gazetted Food Inspector, which is frustrating the remedy of the appeal. 4. The learned Assistant Government Pleader for Services-I submits that the appeal of the Petitioner would be disposed of as expeditiously as possible and an appropriate decision would be communicated to the Petitioner. 5. Heard the learned counsels. 6. Considering the urgency expressed by the Petitioner, the Writ Petition is disposed of with the following directions: i) Respondent No. 1 shall dispose of the appeal filed by the Petitioner dated 09.07.2026 as expeditiously as possible in accordance with law, after giving notice to the persons likely to be effected by any variation in the Seniority List, within a period of six weeks from the date of receipt of a copy of this Order. ii) There shall be no order as to costs.
