Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 16.4.2026 1) The petitioner has filed this petition seeking the following reliefs: “10.1 यह कि उत्तरवा दीगण  किदीशित किय जा वा कि वा परिरशिष्ट प- 01  आधा र पर य शि त   सेवा किवात्तित्त  बा दी मि#ल वा ल स्वात्वा' अवा  गदीरण, ए. प.एसे., से तवा* वात#   एरिरयसे एवा+ ग्रेच्य.टी / उप दी  0 र शि  भु2गत  #य च्य जा अकिवालम्बा र*। NIRMALA RAO 2 10.2 यह कि, अन्य अ2तष जा # य न्य य लय उशित से#झे उत्तरवा दीगण से य शि त   दिदील य जा वा*।" 2) Learned counsel for the petitioner would submit that the petitioner retired from the post of Lineman on account of superannuation on 31.5.2018. He would contend that the petitioner has not been extended the benefits of New Pension Scheme (NPS), 7th Pay Commission, its arrears, gratuity etc. He would submit that a direction may be issued to the respondent authorities to consider the claim of the petitioner and make payment expeditiously as the petitioner is a retired government servant. 3) On the other hand, learned counsel for the State would submit that the benefits of 7th Pay Commission have already been extended to the petitioner and this fact is evident from the document Annexure-R/2 dated 29.9.2022 wherein name of the petitioner appears at Sr. No.93 and a sum of Rs.1,36,493/- has been transferred to his account. With regard to other dues, he would submit that NPS benefits have already been granted to the petitioner and a decision has been taken on 1.2.2018 to not grant arrears for the 7th Pay Commission. He would submit that the petitioner has not challenged the said order. He would contend that the grievance of the petitioner has already been redressed, thus, this petition deserves to be dismissed. 4) I have heard learned counsel for the parties and perused the documents placed in the file. 3 5) A perusal of the return filed by the State would reveal that the benefit of New Pension Scheme and 7th Pay Commission has already been extended to the petitioner. With regard to arrears of 7th Pay Commission, a policy decision has been taken not to grant such benefits to the government servant. 6) Taking into consideration the above-discussed facts, the petitioner is permitted to make a detailed representation before respondents No.2 & 3 within a period of 45 days from today and in turn, the said authorities are directed to decide the representation so made by the petitioner, preferably within a period of 120 days.
