2026:UHC:4826 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS WPMS 1818/2026 Hon’ble Manoj Kumar Tiwari, J. Ms. Priyanka Agrawal, Advocate, for the petitioner. (2) Petitioner filed a suit for permanent injunction, which is numbered as O.S. No. 224 of 2026. In that suit, petitioner filed an application seeking temporary injunction. Learned Trial Court issued notice on the said application, fixing 14.7.2026. Petitioner has approached this Court with the contention that having regard to the facts of the case, Trial Court ought to have passed ex parte temporary injunction in favour of the petitioner. (3) This Court is not impressed by the said submission. Issuance of notice is the rule and grant of ex parte temporary injunction is exception. Since the course of action adopted by learned Trial Court is strictly as per law, therefore, impugned order cannot be faulted. Thus there is no scope for interference in the matter. Writ petition, however, is disposed of with a request to the Trial Court to make endeavour to decide petitioner’s temporary injunction application on the next date fixed, provided all the respondents are served.
