The applicant has preferred this Second Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail, as he has been arrested in connection with Crime No. 322/2025, registered at Police Station – Kondagaon District– Kondagaon (C.G.) for the offence punishable under Sections 317 (2), 317 (5) and 3 (5) of BNS, 2023. 2. Earlier the first bail application of the applicant was rejected by this Court vide order dated 11.03.2026 passed in MCRC No.8967/2025, on merits. Digitally signed by AMIT PATEL 2 3. The prosecution story in brief is that, one Aman Paswan, who was working in the Village Post Office told the present applicant and the co- accused to open accounts for them and offered them money for the same. Ravikant Sahu, told Lokeshwar Hirwani that he would give him work, open his joint account, a joint account will give him more work. Thereafter, Lokeshwar Hirwani along with Kameshwar Nag opened joint account and same was given to the accused person. Thereafter the main accused Aman Paswan sent the account number to Gaurav Raut. All transactions were made via the joint account of the Lokeshwar Hirwani and Kameshwar Nag by the main accused Aman Pashwan and Gourav Raut, thereafter police caught the Lokeshwar Hirwani and Kameshwar Nag they have stated against the applicant and other accused, Therefore, the police of Police Station- Kondagaon has registered the FIR bearing Crime No. 322/2025 offences punishable under section 317(2), 317(5) and 3(5) BNS, 2023 against the present applicant and other co-accused persons. 4. Learned counsel for the applicant submits that he has preferred the present bail application for grant of interim bail on the ground that the marriage of the applicant’s sister is to be solemnized from 24.04.2026 to 26.04.2026. Being the only brother in the family, the applicant’s presence is essential to ensure that all arrangements for the marriage are properly made. It is further submitted that a copy of the marriage invitation card has been filed along with the application. Learned counsel for the applicant further submits that no witness has been examined in the trial so far. Hence, he prays for grant of interim bail to the applicant on this ground. 3 5. In compliance of the Court’s order dated 09.04.2026, this Court directed the learned State Counsel to verify whether the marriage of the present applicant’s sister is scheduled to be solemnized from 24.04.2026 to 26.04.2026. 6. Learned State counsel submits that he has verified the facts regarding the marriage of the applicant’s sister and confirms that it is scheduled to be held on 26.04.2026. It is further submitted that the first bail application of the applicant being MCRC No. 8967/2025 has already been rejected by this Court vide order dated 11.03.2026, on merits and similarly, the bail application of the co-accused was rejected by this Court vide order dated 11.03.2026 in MCRC No. 1968 of 2026. Hence, he prays that the present application be also dismissed. 7. I have heard learned counsel for the parties and perused the case diary. 8. Considering the aforesaid facts and circumstances of the case, and upon perusal of the material available on record, it appears that during the course of investigation it was revealed that the bank account of Lokeshwar Hirwani and Kameshwar Nag in Central Bank of India, Kondagaon Branch was used for cyber fraud transactions and an amount of Rs. 72,09,424/- was transacted through the said account. It has also been found that as many as 41 online cyber fraud complaints have been received from different cities across the country against the said account. The investigation further reveals that the present applicant Ravikant Sahu and co-accused Chandra Shekhar Nayak had induced the account holders to open the joint account on the pretext of providing them employment and thereafter obtained the passbook, internet banking password and cheque book, thereby gaining control 4 over the said account. During investigation, various bank passbooks, ATM cards, mobile phones and SIM cards were seized from the possession of the applicants. It has also come on record that an amount of Rs. 9,77,14,814/- was credited and Rs.9,75,91,522/- was debited from the said bank accounts within a short span of time, indicating the involvement of the applicant in large-scale cyber fraud activities. Considering the serious nature and gravity of the offence, the manner in which the alleged crime has been committed, the huge amount involved and the possibility of the applicant absconding or influencing the witnesses if released on bail, this Court is not inclined to grant bail to the applicant. Accordingly, the bail application filed by the present applicant deserves to be and is hereby rejected as no new ground has been raised worth consideration. 9. Accordingly, the Second bail application of the applicant, namely Ravikant Sahu, involved in Crime No. 322/2025, registered at Police Station- Kondagaon, District- Kondagoan (C.G.) for the offence punishable under Sections 317 (2), 317 (5) and 3 (5) of the BNS, 2023 is hereby rejected. 10. However, considering the fact that the marriage of the applicant’s sister is scheduled to be solemnized on 26.04.2026 and the marriage card has also been annexed as Annexure A/3, this Court finds it appropriate to permit the applicant to attend the said ceremony under police custody for fulfilling the necessary rituals. 11. Accordingly, it is directed that the applicant, namely Ravikant Sahu, who is presently confined in Central Jail, Jagdalpur (C.G.) in connection with Crime No. 322/2025 registered at Police Station Kondagaon, District Kondagaon for the offences punishable under 5 Sections 317(2), 317(5) and 3(5) of BNS, shall be taken in police custody for attending marriage ceremony of his sister which is scheduled to be held on 26.04.2026 with adequate police force. 12. The concerned Superintendent of Central Jail is directed to make all the necessary arrangement with the help of Superintendent of Police, Bastar (C.G.) to take the applicant Ravikant Sahu from Jail on 26.04.2026 at 10:00 A.M. to attend the marriage ceremony of his sister in police custody. The applicant shall be brought back to jail on 27.04.2026 at 11:00 A.M. 13. The Registrar (Judicial) of this Court is directed to forthwith communicate a copy of this order to the concerned trial Court, concerned Jail Superintendent and concerned Superintendent of Police for necessary information and strict compliance.
