1. The petitioner is accused in proceedings arising out of FIR No. 58/2017 dated 22.01.2017 and FIR No. 157/2017 dated 18.02.2017 both registered at Police Station Jamia Nagar, District South East, Delhi. The proceedings are pending before the learned Metropolitan Magistrate-03, District South East, Saket Courts, Delhi.
2. The petitioner, who appears in person, submits that he has made applications alleging perjury against the complainant, which remain pending before the learned Magistrate’s Court. By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks directions for expeditious adjudication of the applications filed by him and for the said applications to be taken up together.
3. Having heard the petitioner and Ms. Manjeet Arya, learned Additional Public Prosecutor, who appears for the State, I am of the view This is a digitally signed order. CRL.M.C. 1383/2026 that the petitioner may move the Court before which the applications are pending, for expeditious
consideration of those applications in accordance with law. No orders are required from this Court at this stage.
4. As notice has not been issued to the complainant, it is made clear that it is for the learned Magistrate’s Court to take an appropriate decision upon notice to all concerned parties, in accordance with law. This Court has made no observations in this regard
5. The petition is, therefore, disposed of in the above terms, without prejudice to the rights and contention of the petitioner and the complainant before the Magistrate.
