Petitioner was working as Lady Conductor with the respondent-Corporation. When her name was not found in the eligibility list for promotion, she moved the present writ petition for following reliefs:- i) Issue a writ or order in the nature of certiorari quashing the impugned select/eligibility list dated 25.09.2023 of candidates published for purpose of departmental exam (Contained as Annexure No.8) by Respondent No.2, by which the petitioner without any reason has been excluded from zone of consideration of promotion. ii) Issue a writ, order or direction in nature of mandamus directing respondents to consider the case of the petitioner for grant of promotion to the post of Officer Assistant II from the date of its vacancy with all consequential benefits.

Coordinate Bench of this Court vide order dated 26.09.2023 passed an interim order, whereby, petitioner was permitted to participate in promotion exercise and it was directed that her result shall not be declared, without leave of this Court.

Coordinate Bench of this Court vide order dated 02.06.2026 directed the learned counsel for respondents to produce result of the petitioner in both the promotion exercise, in different sealed cover.

Today,
learned counsel for respondents produced both the results of petitioner of promotion exercise before this Court.

Learned counsel for respondents-Corporation submits that petitioner participated in the promotion exercise by the Select Committee constituted on 11.10.2023 for promotion on the post of Junior Clerk. As per the report of Committee dated 11.10.2023, petitioner was found suitable, however, her result was not declared in view of the interim order dated 26.09.2023 passed by Coordinate Bench of this Court. In subsequent promotional exercise held on 09.10.2025 by the Selection Committee, it is informed that the final result of the subsequent examination has yet not been received.

In view of the order dated 11.10.2023, petitioner shall be promoted on the post of Junior Clerk, on which post she was found fit for promotion from the date other candidates who participated in the said promotion exercise, with other consequential benefits as admissible under law.

In view of the above, the writ petition is allowed.

The result dated 11.10.2023 and 08.10.2025 are returned to learned counsel for respondents- Corporation.
Learned counsel for respondents- Corporation shall provide the photocopy of those results before this Court to be placed on record.

Pending application(s), if any, stands disposed of.
